It was using art work from mario. If it was anything to do with copyright issues then the creators of mario could start issuing copyright claims. What I said does make sense, you just didn't comprehend it..

Note: It was shut down because the guy was receiving threats on his twitter. But let me clarify my previous post. I meant to say I wouldn't be surprised if apple shut the game down due to copyright.
