But to legally use the textures you need to own CS:S, don't you?

Honestly I wish people would ditch using Source resources and instead use Global Offensive. But apparently GMod runs an older version of the Source engine, and CSGO uses a newer version, so I'm not sure that it would be possible to directly use assets from it...

Yeah, legally. A hell of a lot of people download the textures though, you won't get banned and I've never seen anyone get into any sort of trouble about it.
