Is Nyan cat image copyrighted?

I was going to use the image as a hat for my atre submission but couldn't figure out if it was copyrighted, I know they used it in the bullets for the basic bow but wanted to ask the community first

While it may not be trustworthy, Wikipedia says "In May 2013, Christopher Torres and Charles Schmidt, the creators of Nyan Cat and Keyboard Cat respectively, jointly sued 5th Cell and Warner Bros. for copyright infringement and trademark infringement over the appearance of these characters without permission in the Scribblenauts series of video games".

So, I guess it is.
