Apparently you can according to the guy I'm talking to.
If you're using the drill you will fail the speed test.
Idk, you will only get jailed if you use macro (automated movement system) in mining. Frame rate hack is another hack that faster your speed, the server will do its job to check for these people.

Looks like a faked jail cause.
And yes, the drill can make you fail frame rate test at high mining levels. I know because I was jailed wrongly for it when I was level 85.
And to clear up a common mistake... using a macro doesn't make you mine faster, it just does the work for you at whatever speed you were already able to mine at.
