He doesn't jail u
He only gives u a warning and if u have been warned before you're auto jailed

Depending on what you said, you may receive a warning after being gagged, which may result in a jail depending on previous offences.

Gagging is quicker then submitting a warning so depending on the situation yes you could get gagged then jailed if the server determines that after the warning. As for the question no it is not nessary to gag then jail.
