I think she was referring to the data on ur phone, and in that case, the data assigns you a random IP, so if someone has been jailed on that IP, you will get jailed. It'd be very rare, but can still happen.

Both work similar to each other. Data most likely uses a similar IP range, so it's near impossible for you to get jailed unless someone in your town got jailed on that IP. VPNs can give you a COMPLETELY random IP, making it quite likely that you'll get jailed, since anyone from Era could be using that VPN IP.
