Someone who uses VPN isn't necessarily a hacker. But, this is a sort of exploitation if indeed this person was using a VPN. How do you prove that someone has a VPN or simply a horrible connection? Well... I'm sorry.
Do you know that tip, or more of a rule, that says ''shoot the opponent where you imagine he will be''? Yeah, just keep using it.
