Not necessarily. I believe the loser simply loses their points they spent and the winner gets a reasonably higher amount of points than what they paid. Good system by my standards.

It would be tough for a gang to boost. John said himself that it would take a long time for a gang to get enough points to start a war.

Lol, all the high gangs are gonna get spammed with war messages xD
